Chair Brown called the meeting to order at 9:00 a.m.

    That the minutes of the September 24th, 2024 Committee of Adjustment meeting be approved as circulated.

Liam Doughtey (Agent), Kyle Mohaham (Applicant), Ryan Mohaham (Realator and applicants brother)

Liam Doughtey requested a deferral of the application to address comments from the planning report. He explained that the current lot configuration was designed to maintain the natural seasonal water flow for the two parcels fronting Erie Street. 

Liam Doughtey disagreed with the planning staff's recommendation to maintain the 30-meter lot frontage, arguing it would negatively impact the natural stormwater management (SWM). He proposed modifying the lot frontages to 20 meters and 40 meters but emphasized the importance of preserving the natural flow.

Regarding the parcels fronting Church Street, Planning Staff noted that roads would not allow access at that location, and the area is currently without water supply. Larger lot sizes are planned to accommodate future infrastructure. Once water lines are extended to Nanticoke, the current lot configuration will align with natural development progression.

 Liam Doughtey expressed willingness to engage with roads departments to adjust plans as necessary, but also notes that his interoperation of the 30 meter frontage is created for the intention of not contaminating neighbors, not meant for uniform residential lot line.

 A neighbor raised concerns about Lot 2, citing marshland, backfilling, and safety issues due to a blind hill and speeding vehicles with only 15 meters of frontage this is hazardous.

 Kyle Mohaham expressed his intention to live on the property and run a small market farm in retirement. He acknowledged the helpfulness of the planning comments and agreed to defer the application to ensure the best outcome for future and existing owners.

 Member Makey has concerns of the wetland characteristics and how developable it would be considering the amounts of wetland characteristics given.

    THAT applications PLB-2024-182, PLB-2024-183, PLB-2024-184 and PLB-2024-185 be deferred to allow the applicants time to reduce the overall proposal by one (1) application and to reconfigure the lots into a supportable lotting configuration.

 Member Fleck did not see the sign at time of site visit.

 Planning staff can confirm that the sign was posted in accordance to the Planning Act, Member Makey also confirms he saw the sign at the time of site visit as well.

    THAT application PLA-2024-188 be approved. The application meets the four tests of a minor variance.

 Mr.Janekova (Applicants Husband), Dave Robinson (Neighbor)

 Mr.Janekova expressed that the reason for the sea containers was to protect personal properties from damage caused by large amount of rats on the property, and they were unaware that the sea containers were not permitted on the property.

 Dave Robinson owns all the property to the south and east side of applicant, and says he is speaking for the neighbors across the road as well as for himself on the opposition of the application.

 Dave Robinson explains that the rat problem was caused by previous neighbour owning donkeys and other farm animals, and not keeping up with the property. Since the property has been cleaned up, the rat problem has mitigated. He notes that the property already contains a large amount of accessory structures and that adding the sea containers is not compatible with the surrounding land uses. 

 Member Makey asks if the sea containers are the only issue that was brought to attention by By-Law Officers.

 Mr.Janeckova confirms that the sea containers were the only issues brought to attention from the By-Law Officers.

 Member Fleck questions if the other six sheds are planned to be removed if they are not able to keep products safe.

Mr.Janeckova confirms that a couple of the sheds can be removed, and expresses that the sea containers are only meant to be short term.

 Chair Brown asks applicant to confirm how many sea containers are on the property

 Mr.Janeckova confirms that there are two sea cans on the property.

    THAT application PLA-2024-189 be deferred to allow the applicant time to provide a septic evaluation and confirm the side yard setbacks.

    THAT application PLA-2024-208 meets the four tests of a minor variance. Therefore, Planning staff recommend approval of this application subject to the following conditions:

    1. That the applicant provide to the Building and Municipal Enforcement Division a permit or letter from the Niagara Peninsula Conservation Authority (NPCA) stating that all NPCA concerns have been addressed prior to receiving a building permit.

Don Ricker asks for clarification on if this application has already come forward previously

Planning Staff clarify that 53 trailer sites were permitted in a previous application, now they are coming forward to propose 56 trailer sites.

Kernal Ageru adds comment that they currently have the concurrent site plan application for 56 trailer sites.
